Don't Torrent sites have their foot in the door of that famous 'Grey Area' though? As they claim that they aren't doing anything illegal because they aren't physically hosting any warez/music/movies...
I think because of this, they could be forced to stop using the logo.

Providing access to torrents themselves is a grey area, but the logo use is not anywhere in the least.

Doesn't matter what they do or don't distribute. It's the very USE of a non-public image that's illegal. So it would be very easy to get a C&D order from any decent lawyer for the logo.

Would you want your shiny new game you've spent years on, building an image and a massive userbase, to have its public visual identity (the logo) associated with such a site (illegal or not)?

The lack of interest to make copyright laws more "bullet proof" is the reason that is not exactly illegal or legal.
