Where do i stand? (selling bike content)
Ok, so i posted this on another forum and a few people wanted to see so im posting it here, would like your views also.

Tuesday:

Sold my bike on Monday, guy bought it for his son and sent a driver to have a look at it on the friday. Guy comes started fine and he ran it round the yard for a while, says the rear tyres a bit on the limit and he wants the battery charging. Anyway, hes comes on the Monday and the fecking thing wouldn't start, batterys flat again so it needs a new battery (fair enough i think seen as its £300 cheaper than an equivelent bike on the trader) so put the pack on it and it wouldnt start. So take the plug out and its p**s wet through so dry it off and put a lighter on it for 30secs and pop it back in, still nothing, pull it back out and its p**s wet through again. So put the ball in the drivers court and said what do you want to do and he said he wants to take it so he did.

Now ive not spoken to the guy that bought it yet but hes been on the phone to my dad having a moan about the tyre, battery and saying its not sparking. So now im like The driver knew about the tyre, surely he rang to tell him? Then the driver (who was sent to look over it also because hes a bike person) still took it even though he saw i couldn't get it to start and now the guys moaning, is it not his fault for being a lasy c**t and not keeping in touch with his driver/not coming himself? I put the price so low so i didn't have this all the agro. I know if i have it for 20mins i can get it running again, just needs drying out in the housing and a new spark plug.

So am i being an **** or is he being a bit too fussy? I can see him wanting his money back and me to pick it up to which my response will be GTFO. I saved the guy £300 and hes moaning about something that will cost £40 at the most to put right.

Unluckily i also sold it on my dads trade account, so don't know if that works to his advantage or not.

Yep my bike, that's what i thought too, don't want to be an **** and thinking hes been ripped off but i don't see how he can complain. tbh im half tempted to get it back off him, put a new battery on it, new tyre, fix the plug and put it in at £800 but just more hassle i don't need when i was planning to buy my car with the money tomorrow :\

What i don't understand is why the guy didn't ring to tell him that it wasn't running. I think hes going to try and say the guy was just collecting it and it wasn't as described on the advert, but someone collecting doesn't drive it around the yard and try and haggle me on the price. Should speak to him in about 20mins so we'll see.


Today:

So the driver dropped it off today and i sent it to a friend of the family who i bought it off who knows his stuff on 2 strokes. Now the guy says he's had it running at his place turned it off nad then it wouldn't start again, so got it back put a new plug in and it just wouldn't spark, then he tells me he stuck a screwdriver in it and it was sparking for him so its stopped sparking whilst in his posession Nigel (the mechanic) says the screwdriver could have blown the CID which is £400 because its all coded or the peugeot specialist said because its been stodd for a few months the wires in the back of the clocks could have gone mouldy he said the emobaliser light would stay off, which it is doing. Also forgot to mention there a big ass scrape down the side of it aswell which they tried to touch in.

So, just spoke to him on the phone and im basically getting threats saying if its not running tomorrow hes coming down to get his money. I kindly explained that he has no chance legally (he threatened solicitors too) because A: He accepted the bike wasn't running and took it B: He has actually had it running at his house.

So hes not best pleased, can't beleive how much of a dickhead hes being when the mechanic isnt charging him, if we have to take it to the specialist shop i won't be charging fuel or anything, im doing everything out of good will and getting it thrown back in my face. Its the risk you take buying something used, if you don't lovely like it buy a new scooter.

All private sales are "sold as seen" and that's the same thing that a lawyer would tell him. There's no comeback on it and he should know better. Especially if he's been doing retarded stuff like sticking screwdrivers in spark plugs. Even if it had been working before, that act alone could have messed it up and there's no way to prove it either way.
he sounds like a dick. but, in all honesty, he does have two choices... take the bike or his money.

i wouldn't have let him return it in the first place though.
He didn't return it, in an act of generosity i said id give it to my mechanic to have a go at fixing. He hasn't got two choices the only choice atm im willing to agree with is him picking the bike up.

Buyer beware. 2nd hand vehicles are always full of the previous owners problems. I usually factor in 10-20% purchase price into repairs before i buy anyway.

The fact that the listing you linked shows it as a 'Trade Seller' may not work in your favour.
IIRC he has a lot more rights than if it was a private sale.
Im not a trader though, i just put it on trade as its the only account i have access to and its my dads.
